  • In places where a majority of voters supported Initiative 190 in November 2020, adult-use sales could begin in January 2022. In places where a majority of voters opposed Initiative 190, the sale of adult-use marijuana will remain prohibited.
  • Some medical marijuana licensees will also be allowed to sell adult-use marijuana starting January 1, 2022.
  • On January 1, 2022, cannabis dispensaries in Montana may begin selling marijuana or cannabis commercially.
  • It is illegal to smoke marijuana or cannabis in public places in Montana.
  • From January 1, 2022, until July 1, 2023, only Montana medical marijuana licensees who were licensed on November 3, 2020, maybe issued a license to cultivate, manufacture or sell adult-use marijuana.
  • Montana residents who do not wish to grow their own marijuana or cannabis and do not have a medical marijuana card must wait until January 1, 2022.

In Helena city of Montana, it is no longer illegal to possess small amounts of marijuana for recreational use. But there will be limits to the THC content in adult-use marijuana products, like for marijuana flowers, the totals psychoactive THC may not exceed 35%, and for CBD topicals may contain no more than 800 mg of THC per package. CBD capsules, pills, and tablets may contain more than 100 mg of THC.
