Cannabis is a plant that has been growing or used for both medical and recreational purposes. Indica and Sativa are the two types of cannabis plants with psychoactive properties. There are many cannabis products such as edibles, concentrates, and topicals that are consumed by thousands of people in Montana for recreational or medical use. But there are some laws that are compulsory to be followed by users before consuming cannabis-related items. In the Montana state, from January 1, 2021, cannabis is legal for both medical and recreational reasons. In the starting of 1929, cannabis was illegal for recreational use, and consuming or selling medical cannabis was legalized by ballot initiative. The law legalizing cannabis was changed several times in the 90s. Even the Montana Legislature passed repeals to tighten the Montana medical marijuana laws, which were never approved by the governor.

  • Adults(21 years old and above) can possess and use not more than 1 oz(28.35g) for personal use.
  • As of January 1, 2022, the only legal way to obtain marijuana in Montana is to grow your own.
  • In places where a majority of voters supported Initiative 190 in November 2020, adult-use sales could begin in January 2022. In places where a majority of voters opposed Initiative 190, the sale of adult-use marijuana will remain prohibited.
  • Some medical marijuana licensees will also be allowed to sell adult-use marijuana starting January 1, 2022.
  • On January 1, 2022, cannabis dispensaries in Montana may begin selling marijuana or cannabis commercially.
  • It is illegal to smoke marijuana or cannabis in public places in Montana.
  • From January 1, 2022, until July 1, 2023, only Montana medical marijuana licensees who were licensed on November 3, 2020, maybe issued a license to cultivate, manufacture or sell adult-use marijuana.
  • Montana residents who do not wish to grow their own marijuana or cannabis and do not have a medical marijuana card must wait until January 1, 2022.

In Helena city of Montana, it is no longer illegal to possess small amounts of marijuana for recreational use. But there will be limits to the THC content in adult-use marijuana products, like for marijuana flowers, the totals psychoactive THC may not exceed 35%, and for CBD topicals may contain no more than 800 mg of THC per package. CBD capsules, pills, and tablets may contain more than 100 mg of THC.
